No, in cases related to immigration. Immigration and Citizenship law is federal, so the lawyer only needs to be licensed and accredited in any state of the United States. However, in state matters such as criminal, family, and civil cases, Valencia & Diaz focuses on issues within the state of Ohio.

The answer depends entirely on the facts of your life and how we apply immigration and citizenship law to your particular case. To obtain a work permit in the United States, the immigrant must have a specific immigration situation and/or application that allows them to obtain the work permit. An immigrant cannot file a work permit application without the law previously permitting it. The only way to know if immigration and citizenship law allows a work permit for an immigrant is by scheduling a consultation with an experienced lawyer.

No. This is a big rumor and confusion in the immigrant community. There is no immigration and citizenship law that provides immediate immigration benefits solely for having lived in the United States for 10 years. This confusion stems from an immigration relief/request that can only be filed in Immigration Court, and one of the requirements of this request is to be able to prove the immigrant's continuous and physical residence in the United States for at least 10 years prior to the notification of the lawsuit. This immigration relief is called cancellation of removal, however, it is also necessary to prove the relationship with an American citizen or resident family member, good moral character of the immigrant, and extreme and unusual hardship to the American citizen or resident family member.

It is advisable to refrain from traveling within the United States if you are in the country without immigration status. Airports are establishments where, by law, we have less expectation of privacy, and with the presence of customs and border officials, you could be subjected to searches and questioning without any justified cause from immigration officials.

In general, no. There are humanitarian petitions where having an American citizen child is decisive for the immigration relief of the parents. However, through the family route, parents who have entered the United States undocumented cannot obtain a pardon for entry and undocumented stay solely through the family petition of an American citizen child over 21 years old. There must necessarily be other factors, such as the following: the American citizen child is an active member of the military, or the American citizen child has or is abusing the parent, or there is previously a petition with benefits from law 245i, or the parent is before the immigration court and is filing a cancellation of removal petition.

The U nonimmigrant status (commonly called U Visa) is reserved for victims of certain crimes, who have suffered physical or mental abuse and have provided assistance to police departments, judges, or prosecutors in the investigation or prosecution of criminal activities.

Congress only authorizes 10,000 visas for each fiscal year. The number of applications registered each year greatly exceeds the 10,000 visas. Likewise, the delay in reviewing these requests by the government is unreasonable. For this reason, the government granted the possibility of obtaining a work permit while waiting for the adjudication of the application. This work permit can take several years.
